The Employment Rights Bill presents several key reforms that will impact the construction sector. Here are the most important takeaways for businesses to note:
- Unfair Dismissal: By autumn 2026, protection from unfair dismissal will become a day-one right. While a nine-month probation period may be allowed, the government’s proposed change marks a significant shift from the current law, which gives employers two years before unfair dismissal rights apply.
- Fire and Rehire: It will soon be automatically unfair to dismiss an employee who refuses a variation in their contract, preventing practices such as replacing workers with new employees on inferior terms.
- Zero-Hour Contracts: Employers will be required to offer guaranteed hours to employees on zero-hour contracts, providing workers with more stability.
